1. Cancellation & Rescheduling
Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee equal to 50% of the quoted service price. Rescheduling requests should be made as early as possible and are subject to availability.
2. Client Responsibilities
The Client is responsible for ensuring the property is accessible, presentable, and ready for imaging at the scheduled time. 360 ProScan is not liable for delays or inability to complete services caused by access issues, occupants, pets, or property conditions. The Client is also responsible for notifying 360 ProScan Advanced Imaging promptly upon the sale or transfer of the property.
3. Deliverables & Turnaround
Final deliverables will be provided digitally via a secure link or cloud transfer within the agreed timeframe. Turnaround times are estimates and may vary based on project complexity and scheduling volume.
4. Hosting & Storage
Virtual tour links are provided with a complimentary 3-month hosting period from the date of delivery. Continued hosting beyond 3 months is available at a rate of $50.00 per 3-month renewal period. 360 ProScan will make reasonable efforts to notify the Client prior to expiration. Content not renewed within 30 days of expiration may be removed from hosting without further notice.
5. Revisions
Minor post-processing adjustments are included at no additional cost. Significant reshoots or additional editing beyond the original agreed scope will be quoted separately and require written approval prior to commencement.
6. Perpetual Media Rights
360 ProScan Advanced Imaging retains a non-exclusive, royalty-free, perpetual license to display, publish, and promote any photographs, video, 3D scan data, virtual tour content, or other media captured during the engagement. This includes use on the 360 ProScan website, social media platforms, and marketing materials, at any time and without further notice, approval, or compensation to the Client.
7. Limitation of Liability
360 ProScan's total liability shall not exceed the total fees paid by the Client for the specific services giving rise to the claim. 360 ProScan is not responsible for indirect, consequential, incidental, or punitive damages of any kind.
8. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this agreement shall be resolved exclusively in Lee County, Florida.
